What information is checked?
The information which is checked to complete a disclosure includes:
- Details of convictions and cautions held on the Police National Computer (for offences committed in Scotland, England and Wales) or Criminal History System (CHS)
- Information about a person's inclusion on the lists operated by the Department of Health and Department for Education and Skills. A list of people who are banned from working with adults in Scotland is being compiled and this will also be checked
- Other information held by a local police force and thought to be relevant to the position applied for.
Spent and unspent convictions
Under the Rehabilitation of Offenders Act 1974, many convictions can become 'spent' following a rehabilitation period. The rehabilitation period will vary depending on the conviction. An unspent conviction is one where the rehabilitation period has not expired. A custodial sentence of more than two and a half years will never become spent.
